Terms of Service

1. Acceptance of these terms

By creating an account or using Surfacly you agree to these Terms. If you don't agree, don't use the service.

These terms can change. Material changes are emailed 14 days before they take effect; continued use after that date counts as acceptance.

2. The service

Surfacly provides product-audit, AI-fix, citation-tracking, and reporting tooling for online merchants. Specific features are described on the marketing site and may change as the product evolves.

We aim for 99.5% monthly uptime. We don't guarantee it; planned maintenance, third-party LLM outages, and force-majeure events are excluded.

3. Your account

You're responsible for keeping your login credentials secret and for everything that happens under your account.

API keys you generate are scoped to your workspace's domain. Sharing or leaking a key is your responsibility — rotate it from settings if compromised.

4. Acceptable use

Don't use the service to audit catalogs you don't own or have permission to access.

Don't reverse-engineer the product or attempt to bypass tier limits, rate limits, or billing controls.

Don't generate content via Surfacly that's illegal, defamatory, or violates third-party rights.

5. Billing

Subscription tiers are billed monthly via Stripe. Top-up credit packs are one-time charges and don't expire.

Refunds within 14 days of the most recent charge if you've used less than 10% of your monthly credit allotment. Beyond that we evaluate case-by-case — email billing@surfacly.com.

Failed payments pause new audit runs after 7 days. Existing data stays intact for 30 days, then is archived for restoration on request for another 60 days.

6. Your data

You own your catalog data and any reports we generate from it. You grant us a limited licence to process it for the purpose of running the service.

We don't train external LLMs on your data. See the Privacy Policy for sub-processors and data-flow specifics.

Export or delete your data at any time via the workspace Danger Zone or by emailing hello@surfacly.com.

7. AI-generated content

Surfacly drafts product copy, schema, and alt text using LLMs. The AI fix dialog gives you a diff to review before anything is applied to your store.

You're responsible for the final content that ships on your storefront. We make best-effort, but generated copy is suggestion-grade — review it.

8. Limitation of liability

Surfacly is provided "as is". To the maximum extent permitted by law, our liability is capped at the amount you paid us in the 12 months preceding the claim.

We're not liable for lost revenue, lost data, or indirect damages.

9. Termination

Either side can terminate at any time. You can cancel from billing settings; we can terminate for breach with 14 days' notice (immediate for severe abuse).

On termination your data is archived for 60 days then deleted, unless you request earlier deletion.

10. Governing law

These terms are governed by the laws of [JURISDICTION TO BE FILLED IN]. Disputes resolve in that jurisdiction's courts.
